What Dive Overlay Studio is

Dive Overlay Studio is a web app that reads dive data files from dive watches and dive computers, such as Garmin FIT files, and turns them into video overlays showing depth, heart rate, dive time, and other readouts. Your dive files are processed in your own web browser and are not uploaded to us.

Your account

• You need an account to export overlays. Give us a real email address and keep your password private.
• You are responsible for activity on your account. Tell us at support@freedivedata.com if you think someone else has accessed it.
• One account is for one person. Please don't share logins or resell access.
• You must be at least 13 years old to use the service. If you are under 18, a parent or guardian must agree to these terms.

Plans and payment

• Free plan. Free accounts can preview every style and readout and make a limited number of exports using the basic styles and readouts. We may change what the free plan includes.
• Monthly and annual plans renew automatically at the end of each billing period until you cancel. You can cancel at any time from your account, and you keep access until the end of the period you paid for.
• Lifetime plan is a single payment that gives you the paid features of Dive Overlay Studio, including updates, for as long as we offer the product. It does not include separate future products, such as a native desktop app or other add ons, unless we say so.
• If we change prices, the change applies to your next billing period. We will tell you in advance by email.

Our reseller, Paddle

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payments, taxes, invoices, and payment methods are handled by Paddle under its buyer terms. We never see or store your card details.

Refunds

You can get a full refund within 14 days of any payment. See our refund policy for details.

Your content

Your dive files, your videos, and the overlays you export belong to you. You can use your exported overlays in any videos you make, including commercial and sponsored content, with no credit required.

Acceptable use

Please don't:

• Copy, resell, or redistribute the app or its code, or build a competing product from it.
• Try to get around export limits, account checks, or payment.
• Reverse engineer, scrape, or overload the service, or interfere with other users.
• Use the service for anything illegal.

We may suspend or close accounts that break these rules. If we close a paid account without a good reason, we will refund the unused part of your plan.

Not for dive safety

Dive Overlay Studio is a video tool. Overlays show the data your device recorded and may contain errors from the device, the file, or the software. Never use the app or its output to plan dives, judge decompression, or make any safety decision. Always follow your dive computer, your training, and safe diving practice.

Our property

The app, its design, styles, and code are owned by Van Hook Media LLC and protected by copyright. Your plan gives you a personal, non transferable right to use the app under these terms.

Garmin and Descent are trademarks of Garmin Ltd. or its subsidiaries. Other brand names belong to their owners. Dive Overlay Studio is not affiliated with or endorsed by Garmin or any device maker.

The service is provided as is

We work hard to keep Dive Overlay Studio reliable and accurate, but we provide it "as is" and "as available", without warranties of any kind, to the extent the law allows. We don't promise that it will work with every device, file, or video editor, or that it will always be available.

Limit of liability

To the extent the law allows, Van Hook Media LLC is not liable for indirect, incidental, or consequential damages, or for lost data, footage, or profits. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.

Changes to these terms

We may update these terms as the product changes. If a change is significant, we will tell you by email or in the app before it takes effect. Continuing to use the service after that means you accept the new terms.

Governing law

These terms are governed by the laws of the State of Florida, without regard to its conflict of law rules. Any dispute will be handled in the state or federal courts located in Monroe County, Florida, unless the law where you live gives you the right to bring a claim there.
